1. Purpose

These Terms of Use ("Terms") govern access to and use of the Azura Padel Club application (the "App"), a free community service dedicated to padel: player profiles, ELO ranking, match organisation and validation, and messaging.

2. Acceptance

By creating an account or using the App, you unreservedly accept these Terms as well as the Privacy Policy. If you do not accept these terms, do not use the App.

3. Registration, account and access

• The App is restricted to persons aged at least 13.
• Passwordless authentication: your account is protected by your verified email address (one-time code) and a recovery phrase (18 words). You are solely responsible for their confidentiality and for any activity carried out from your account.
• Device limit: an account may be used on a limited number of devices (anti-sharing / anti-multiple-accounts measure). Any attempt to circumvent this may lead to suspension.
• You agree to provide accurate information, to choose a decent username and not to impersonate any third party.

4. Rules of conduct and content — ZERO TOLERANCE

You are solely responsible for the content you publish (username, profile photo, bio, messages, media). No tolerance is granted to the following content or behaviour, which is strictly prohibited: - nudity, sexual or pornographic content; - content involving or sexualising minors; - hate, racism, antisemitism, xenophobia, discrimination, harassment, threats; - violence, shocking content, self-harm, glorification of terrorism or extremist ideologies; - impersonation, spam, scams, illegal content; - sports fraud: fake scores, cheating, geolocation circumvention.

Any breach may result in content removal, suspension or permanent banning of the account, without notice.

5. Moderation, reporting and blocking

• Public profile elements (username, profile photo, bio): analysed automatically; inappropriate usernames are rejected at creation.
• Private messaging: exchanges are not moderated beforehand. Every user can report a message or an account, and block another user at any time. Reports are reviewed and may lead to sanctions.
• We reserve the right to remove any content and to sanction any offending account.

6. Matches, ranking and geolocation

• The ranking (ELO/grades) and trophies are based on matches declared and then validated by the players. Any manipulation is prohibited (§4).
• Geolocation is required to validate a match: player presence is verified within a radius of about 500 m around the club where the match is played. Without location enabled, match validation is impossible. We recommend the "while using the app" permission.

7. Messaging and groups

• To write to a player, you send a message request that the recipient can accept, decline or report. An accepted conversation makes you contacts.
• Groups are composed of already-accepted contacts, through an invitation system (each member must accept). Closing a private conversation permanently deletes all exchanges for both parties; leaving a group may lead to its deletion if it becomes too small.

8. Free of charge

The App is currently free and offers no purchases or subscriptions. Any future paid feature will be subject to an update of the App and of these Terms.

9. Intellectual property

The App, its brand, design and original content are protected. You retain your rights over the content you publish, but grant the publisher a non-exclusive, free licence to host and display it as part of the operation of the service. You warrant that you hold the rights to the content you publish.

10. Availability and liability

The App is provided "as is". We strive to ensure its availability and security, without any guarantee of uninterrupted or error-free operation. To the extent permitted by law, we shall not be liable for indirect damages related to the use of the App or to interactions between users.

11. Account suspension and deletion

• You can delete your account at any time from Profile → Settings → Delete my account.
• We may suspend or delete any account in the event of a breach of these Terms, without notice for serious breaches (§4).

12. Personal data

The processing of your data is described in the Privacy Policy, compliant with the GDPR. We do not sell or share your personal data.

13. Changes to these Terms

We may amend these Terms. The update date at the top of this document prevails. Your continued use after an amendment constitutes acceptance.

14. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any action; failing that, the competent courts shall be those of Marseille. EU consumers retain the benefit of the mandatory provisions of their country of residence.

Appendix — App store terms (EULA)

- This licence agreement is concluded between you and the publisher (Sacha Grimaldi), not with Apple or Google. - Apple/Google are not responsible for the App or its content, and have no maintenance or support obligation. - The licence to use the App is personal, non-transferable, limited to devices that you own or control, in accordance with the App Store / Google Play usage rules. - You represent that you are not located in an embargoed country and that you do not appear on any list of prohibited parties.
